SC Collegium stands by the names it recommended


The Supreme Court Collegium, led by Chief Justice of India T.S. Thakur, refused to accept the government’s rejection of 43 names it handpicked for judicial appointments in various High Courts. Supreme Court informed the government recently that it had reiterated every one of the 43 names that was sent back by the Centre to the Collegium for re-consideration. Chief Justice of India T.S. Thakur informed Attorney-General Mukul Rohtagi about this.

The prevalent procedure is that once the Collegium has reiterated its recommendations, the government is bound to clear the names for appointment as judges.

Background

The government had earlier returned the 43, out of a total 77 names, recommended by the Collegium.

Deciphering the Terms

1. Supreme Court of court of India - It is the highest judicial forum & final court of appeal under the Constitution of India, the highest constitutional court,& it has the power of constitutional review.

2. Collegium system - It is a process or a way through which decisions related to appointments and transfer of judges in S.C and high court are taken by a collegium which consists of CJI (Chief Justice of India), four senior most judges of supreme court and three members of concerned high court (in the matter related to high court) including chief justice .

3. Attorney General of India is the chief legal advisor of government of India & its primary lawyer in the Supreme Court of India. President of India appoints the Attorney general for a term under section 76 (1) of Indian Constitution. Mukul Rohtagi is the 14th AG of India.
