Prevention of Insults to National Honour (Amendment) Bill, 2026

  • President Droupadi Murmu has officially granted her assent to the Prevention of Insults to National Honour (Amendment) Bill, 2026, officially turning it into law.
  • This historic approval elevates India's National Song, Vande Mataram, to the exact same statutory protection and legal status as the National Anthem, Jana Gana Mana.

About the Act

 

Key Legal Provisions of the Amended Law

  • Identical Safeguards: The Act amends Section 3 of the original 1971 Act to include specific protections for the National Song.
  • Criminal Liability: Intentionally disrupting, obstructing, or preventing the singing of Vande Mataram is now a cognizable criminal offence.
  • Strict Penalties: Violators can face up to three years of imprisonment, a fine, or both.
  • Repeat Offenders: A second or subsequent conviction carries a mandatory minimum prison sentence of one year.

Implementation and Protocols

  • Official Events: The Ministry of Home Affairs mandates that all six stanzas of Vande Mataram will be performed during official state functions, civil award ceremonies, and programs attended by the President.
  • Public Etiquette: Following previous legal precedents like the Supreme Court's Bijoe Emmanuel ruling, individuals are required to stand respectfully and remain quiet when the song is played, though forced vocal singing is not legally coerced.

SMILE-Beggary Rehabilitation Framework

  • SMILE (Support for Marginalized Individuals for Livelihood and Enterprise), comprising two sub-schemes: Comprehensive Rehabilitation of Persons Engaged in Begging, and Welfare of Transgender Persons.

Provisions of the Model Guidelines

  • Rights-Based Standards: Mandates minimum structural, sanitary, dietary, and medical standards in all Beggars' and Shelter Homes to prevent overcrowding and preserve human dignity.
  • Audits & Oversight: Requires every designated shelter home to conduct mandatory third-party infrastructure and social audits every two years, supervised by District Social Welfare Officers.
  • Digital Ecosystem: Incorporates a specialized mobile app for geo-tagged surveys, profiling, and tracking, integrated directly with the SMILE-Beggary National Portal for real-time progress updates.
  • Target-Specific Rehabilitation Strategies
  • For Adults: Tailored vocational training (e.g., tailoring, e-rickshaw operations, gardening, food processing) coupled with Self-Help Group (SHG) formation and institutional bank credit linkages.
  • For Children: Complete exemption from manual vocational interventions; focused strictly on age-appropriate formal schooling, Anganwadi integration, or placement under the Juvenile Justice Act, 2015 via Child Welfare Committees.
